Can an employer legally record phone conversations?

The question about whether an employer can legally or illegally record phone conversations is complicated. There’s no expectation of privacy in the workplace. However, there’s a separate body of law under federal law that says that you can’t record someone without their permission, so it’s a little bit unclear in the workplace, but generally, no. If an employer is going to record phone calls, they need to let you know and the person who’s on the other end of the call. If they don’t, they’ve probably violated the Florida wiretap statute, as well as, Florida privacy laws.
