Is an employer required to provide maternity parental or other leaves of absence?

Under Florida and federal law, only employers of a certain size, and employees that fall under the definition of a covered employee under the Family and Medical Leave Act, are entitled to parental leave rights, or maternity rights, or any kind of rights with regard to the birthing of a child.

An employer, typically, must have 50 or more employees in a 75 mile radius, and an employee seeking to have that sort of leave typically has to work for the employer for at least one years as a full-time employee. If those conditions are satisfied, then those employees may have rights for that leave, and the ability to take up to 12 weeks of leave for a situation such as a parental leave, under the FMLA laws.
