What is at-will employment?

  • According to USA.Gov’s guidelines for termination, every state except Montana allows at-will employment, which means employees can be fired for any legitimate, nondiscriminatory reason.
  • At-will employment does not allow employees to be fired based on discrimination against protected characteristics, refusal to conduct illegal activities, or protected activity such as reporting workplace practices.

What are protected characteristics?

  • According to the Equal Employment Opportunity Commission (EEOC), employers  are prohibited from firing employees based on protected characteristics such as race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, age, disability, or genetic information.
  • Employers are also prohibited from firing employees in retaliation for reporting or opposing discrimination

How do I know if I’ve been wrongfully terminated?

  • While it is not illegal for most employers to fire employees based on personal dislike, it is wrongful termination if this dislike is due to discriminatory or retaliatory reasons.
