Are all employers covered under the Fair Labor Standards Act (FLSA)?

The Fair Labor Standards Act is the federal law that regulates employers’ obligations to pay minimum wage and overtime. In order to be covered under the law, your employer has to be subject to the statute. That requires a couple of things. The employer has to have at least two or more employees, not independent contractors but actual employees, and the employer has to have minimum revenues in excess of 500,000, or the employee has to be involved in something involving interstate commerce. That can be a little tricky, but in general what it means is affecting goods and commerce, shipping, packing, taking created cards, processing Medicare claims. If your employer has two or more and probably has revenues over 500,000, or is involved in taking credit cards, there’s a good chance that your employer is covered and should be paying you both overtime and minimum wage.
