Can an employer ever use race, gender, or age in employment decisions?

No. An employer may not use age, race, sex, or gender in making an employment decision for applicants, for hiring purposes, promotion, discipline, evaluations, and particularly for termination. That’s an example of discrimination. If you feel like this has happened to you, you should immediately contact human resources, consider filing what’s called a Charge of Discrimination with the local agencies, and obtaining legal counsel.
