You probably can’t be an employee and an independent contractor, absent some very rare and unique situations. We see a lot of employers classifying individuals as independent contractors and often employees are misclassified. It’s important to know that if you’re classified as independent contractor, you’re missing out on benefits. You’re not getting overtime pay or the ability to claim unemployment upon separation or health benefits. If you feel like you’ve been misclassified, I would raise it with your employer or seek counsel.
