Can I recover punitive damages from my employment discrimination claim?

Whether or not you can recover punitive damages depends on the case. Punitive damages are reserved for the most egregious types of employees. The standard is it’s indignation of your federally protected right. What that usually means is there is direct evidence, horrible comments for example use of the N word in a race discrimination case, or there’s just rampant systemic discrimination that prevalent and can be proven in a larger organization. The amount of punitive damages does depend on the size of the organization if you’re bringing a claim under the Federal EEOC Laws or the Florida Civil Rights Act.
