It’s a good idea for an employer to stray away from questions that may question an employee with regard to a protected trait such as their religion, national origin, their age or other sorts of questions which could give rise to the situation or a presumption that they may be making an employment decision based on that individual’s protected trait. If you have questions about whether or not you’ve been subjected to an employment decision that could potentially be discriminatory, or if you’re an employer who has questions about how to properly conduct an interview to avoid potential liability under discrimination laws, it’s best to seek consultation with an employment lawyer who can give you advice on those questions.
