Who enforces HIPAA?

Return to FAQ Videos

Transcript:

HIPAA’s a federal law that protects PHI, what we call [pi 00:00:08], which is personal healthcare information. Under HIPAA it is only enforced by one organization and that’s the federal government through the Department of Labor. Unlike common perception, HIPAA cannot be enforced by suing in a private court of law. You have to go through the Department of Labor website. That said, HIPAA does set the standard for what constitutes an invasion of privacy so you may have an invasion of privacy claim under your state law.
