In certain situations, discrimination in the workplace may be obvious. An employer may come out and directly make discriminatory comments regarding your gender, national origin, or your age. In those situations, the proof of the discrimination is a little bit easier. However, in other circumstances, we may have what you call circumstantial evidence of discrimination. In these sort of situations, you may be an employee who’s subject to an adverse employment action. Maybe you don’t get a raise like all your other employees, but you realized that you’re a certain individual of a protected class, such as you’re the only female in the workplace, or you’re only a member of a protected race under the employment situation. Therefore, those circumstantial situations may give rise to a potential claim of discrimination in the workplace.
