Can Employers Require Remote Workers to Come Back to Office?

Remote Workers Return To Office

Whether hybrid or full-time, employers in Florida can generally require employees to return to the office, even if they previously worked remotely.

Cathleen Scott, board-certified employment law attorney, explains that under Florida’s at-will employment rules, employers can generally change work conditions, meaning your boss may be within their rights to require you to return to the office.

However, exceptions may apply when remote work is a reasonable accommodation for a disability under the Americans with Disabilities Act (ADA) or other applicable law. Employers may need to consider continued remote or hybrid work as an accommodation, but they are not automatically required to approve it if another effective accommodation is available.

If your employer requires you to return to the office despite a previously approved medical accommodation, consult an employment law attorney to understand your rights and options.

Even if your employer promised a remote position, that does not necessarily mean they must maintain that arrangement indefinitely. The terms of any agreement and the specific circumstances may matter.
