The Fair Credit Reporting Act is the law that governs the background checks that an employer may conduct, either in pre-screening process or during the employment process. There are certain requirements that an employer has to take if they’re going to conduct a background check, either with regard to a criminal background or with a credit report request. If an employer doesn’t abide by those or if they make a decision based on what they learn and they don’t disclose that to the employee that may be a violation of the Fair Credit Reporting Act. If you believe that you’ve been in a situation like this it’s a good idea to seek consultation with an employment lawyer so that you can know for sure what you’re rights might be under the laws.
